1. Scope of application and acceptance
1.1. These General Terms and Conditions govern all purchases made through the e-commerce site managed by L&C LOGISTIC SRL (hereinafter the "Seller") by users acting as consumers (natural persons acting for purposes other than their professional activity) and, where applicable, by businesses or professionals.


1.2. By placing an order, the user declares that he or she has read, understood, and accepted these Terms and Conditions in their entirety.


1.3. These Terms and Conditions are supplemented by the mandatory pre-contractual information, the Privacy Policy / GDPR, the Cookie Policy, and the Withdrawal Policy, which must be made available to the user before the contract is binding.

2. Applicable Law
2.1. For B2C sales, the following apply:
• the Consumer Code (Legislative Decree no. 206 of 6 September 2005) and subsequent amendments, including those introduced by the implementation of EU Directive 2019/2161 (the "New Deal for Consumers").
• Legislative Decree 70/2003, which regulates e-commerce.
• Regulation (EU) 2016/679 ("GDPR") on the protection of personal data.
• Regulation (EU) 2023/988 on general product safety ("GPSR").
• applicable tax and VAT regulations.


2.2. For sales to professionals/businesses, where applicable, the provisions of the Civil Code and those specific to business-to-business transactions apply, unless the user is acting as a consumer.

3. Main information before concluding the contract
Before the user is bound by an order, the Seller provides in a clear, comprehensible, and transparent manner:
• the main characteristics of the goods or services;
• the total price, including VAT and all additional costs (transport, packaging, etc.);
• payment, delivery, and fulfillment methods;
• the existence of the legal guarantee of conformity (24 months for consumers);
• the right of withdrawal, the conditions, terms, and procedures for exercising this right;
• if applicable, the conditions for terminating the contract and the procedures for submitting complaints;
• information relating to product safety (GPSR) and, if applicable, warnings, instructions for use, origin, and potential health/safety hazards;
• Discount policies: If a discount is applied, the lowest price applied in the previous 30 days must also be indicated, as required by the Omnibus Directive.

4. Orders, Contract Conclusion and Acceptance
4.1. The user can select products, add them to the cart, check the price, costs, and conditions before confirming the order.


4.2. The button used to complete the order must contain the wording equivalent to "order with obligation to pay," as required by the Consumer Code.


4.3. The contract is considered concluded when the order is accepted by the Seller, which occurs upon the customer's receipt of the order confirmation via email or other durable medium. 


5. Prices and Payments
5.1. Product prices are expressed in euros, include VAT (where applicable), and include mandatory legal costs.


5.2. Shipping, delivery, or any other additional costs will be clearly indicated before the order is finalized.


5.3. Accepted payment methods include: Credit/Debit Card, PayPal, Apple Pay, Google Pay.

5.4. In the event of payment using payment methods subject to fees, the Seller may not charge the user for costs exceeding those actually incurred.

6. Delivery
6.1. The Seller undertakes to deliver the goods within the timeframe indicated at the time of ordering, except in cases of force majeure or unforeseen circumstances.


6.2. If no timeframe is specified, delivery must take place within 30 days of the conclusion of the contract, unless otherwise agreed.


6.3. The delivery method and location are those indicated by the user at the time of ordering.


6.4. Upon delivery, the customer is requested to immediately check the condition of the package and report any visible damage to the courier. Such reports will facilitate any subsequent actions.

 

7. Consumer Right of Withdrawal
7.1. The consumer has the right to withdraw from the contract, without incurring any costs other than those provided by law, within 14 calendar days from the day on which the consumer or a third party designated by the consumer, other than the carrier, acquires physical possession of the goods.


7.2. To exercise the right of withdrawal, the consumer must communicate their decision by means of an explicit declaration to: info@liesparfum.com.


7.3. After communicating the withdrawal, the consumer has a further 14 days to return the goods, intact, complete with original packaging, labels, accessories, and manuals.


7.4. Return costs are borne by the consumer, unless the Seller indicates otherwise.


7.5. The Seller will refund all payments received from the consumer, including the cost of delivery (but not any additional costs resulting from choosing a delivery method other than the least expensive one offered), within 14 days of the day on which the Seller is informed of the decision to withdraw; The refund may be withheld until the goods are received or until the consumer has demonstrated that they have shipped the goods. The refund will be made using the same payment method used for the purchase, unless otherwise agreed.


7.6. Exceptions to the right of withdrawal: The consumer cannot withdraw in the cases provided for by law, for example:
• goods made to measure or clearly personalized;
• goods that are liable to deteriorate or expire rapidly;
• sealed goods that cannot be returned for reasons of hygiene or health protection and that were unsealed after delivery;
• digital content not supplied on a tangible medium, if the performance has begun with the consumer's express consent and their acceptance of the loss of the right of withdrawal;
• services whose performance has begun with the consumer's express consent and their acceptance that they will lose the right of withdrawal once the service is completed.

8. Warranty
8.1. The products sold by the Seller are subject to the legal guarantee of conformity provided for in Articles 128-135 of the Consumer Code (minimum duration 24 months for consumers).


8.2. The legal guarantee protects the consumer in the event of defects of conformity present at the time of delivery of the goods.


8.3. Any additional commercial guarantees (if offered) do not replace or limit the rights deriving from the legal guarantee; the terms of the commercial guarantee must be clearly communicated.

9. Obligations relating to product safety (GPSR Regulation)
9.1. The Seller ensures that the products offered for sale comply with the safety requirements set forth in Regulation (EU) 2023/988 (GPSR) relating to general product safety.


9.2. The product data sheets provide safety information: warnings, instructions for use, possible health/safety risks, product origin, instructions, and symbols where required by law.

10. Processing of Personal Data
10.1. The Seller is the data controller of the personal data collected through the website. Such data will be processed in accordance with the GDPR (EU Regulation 2016/679).


10.2. The data collected is necessary for order management, delivery, customer service, fulfillment of tax obligations, and, if explicitly accepted, for promotional activities.


10.3. The user has the rights set forth in Articles 15-22 of the GDPR (access, rectification, erasure, restriction, portability, objection) and may exercise them by sending a request to: privacy@liesparfum.com


10.4. The data will be retained for the time necessary for the purposes for which it was collected and in compliance with legal obligations.


10.5. Adequate technical and organizational security measures are implemented to protect the data (e.g., encryption, protected access, backup, use of secure protocols).


10.6. In the event of a personal data breach, the Seller will comply with the notification obligations set forth in the GDPR.

11. Liability
11.1. The Seller is not liable for damages resulting from improper use of the product, incorrect delivery address information by the customer, force majeure events, delays attributable to carriers, or other unforeseeable events beyond its control.


11.2. The Seller shall not be liable for indirect damages, loss of profits, or loss of opportunity, unless such damages are expressly provided for by applicable law.

 

12. Amendments to the Terms
12.1. The Seller reserves the right to modify these Terms at any time, due to regulatory or case law changes, or business needs.


12.2. The amendments will be effective from the date indicated ("effective date") and will be published on the website. Orders already accepted will remain governed by the version in effect at the time of conclusion of the contract.

13. Complaints and Dispute Resolution
13.1. The customer may send complaints to the Seller at the email address: info@liesparfum.com.


13.2. In the event of disputes, if the customer is a consumer, alternative dispute resolution (ADR) methods may be used, if available.


13.3. For consumers, the Court of the place of residence or domicile (where required by law) shall have jurisdiction. For professionals/companies, unless otherwise agreed, the Court of Pavia shall have jurisdiction.

14. Final Provisions


14.1. If one or more provisions of these Terms and Conditions are held to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.


14.2. These Terms and Conditions constitute the entire agreement between Seller and Customer relating to the subject matter hereof.
